The Law for Implementation of the Mutual Recognition between Japan and the European Community and the Republic of Singapore in Relation to Conformity Assessment of Specified Equipment (July 11, 2001, Law No. 111, hereinafter referred to as the "MRA Law") prescribes requirements for implementation of foreign conformity assessment activities. This is in order to secure appropriate implementation of the Agreement on Mutual Recognition between Japan and the European Community (signed on April 4, 2001, put into effect on January 1, 2002, hereinafter referred to as "Japan-EC MRA") and the Japan-Singapore Economic Agreement for a New Age Partnership (signed on January 13, 2002, put into effect on November 30, 2002, hereinafter referred to as "JSEPA"). The Japan-EC MRA encompasses four areas: 1. telecommunication & radio equipment; 2. electrical products; 3. chemicals; and 4. medicinal products. Of these, the MRA Law prescribes requirements for mutual recognition of conformity assessment in two areas, that is: 1. telecommunication & radio equipment; and 2. electrical products. The JSEPA, in Articles 45 to 57, which correspond to Chapter 6, prescribes requirements for mutual recognition of conformity assessment in the same two areas: 1. telecommunication & radio equipment; and 2. electrical products. Under these government-to-government Mutual Recognition Agreements, designated conformity assessment bodies in each country will be registered by the Joint Committee of Japan-EC or Japan-Singapore as competent to undertake conformity assessment against the partner country's regulatory requirements, and the partner country will accept the results of conformity assessment performed by the designated conformity assessment bodies. This means that, as a result of the MRA and the execution of the MRA Law, the importing country will accept as-is the results of conformity assessment activities performed in the exporting country, and will not require any further conformity assessment, such as tests after importing products. This will contribute greatly to a smooth import/export relationship between Japan and the EU and Japan and Singapore. |
